ALBANY, NY – District Attorney P. David Soares today announced that DEVON CALLICUTT, 20, of Albany, NY was sentenced to life without the possibility of parole for the murder of Richard Bailey. CALLICUT was also sentenced to an additional 25 years in prison for the Robbery of a second victim after Richard Bailey was killed.
In December, CALLUCUT was found guilty after a Jury trial of Murder in the First Degree, Attempted Robbery in the First Degree, Criminal Possession of a Weapon in the Second Degree, and Robbery in the First Degree.
On October 20th, 2008, around 11:20 p.m., in the area of South Lake Avenue and Yates Street, CALLICUTT, along with KING MODEST, 18, and RICARDO CALDWELL, 19, approached Richard Bailey on their bikes and attempted to rob him with a loaded handgun in CALLICUTT’s possession. During the robbery, CALLICUTT shot Bailey in the head, causing his death. Following the shooting of Bailey, CALLICUTT robbed another victim at approximately 11:27 p.m., in the area of State Street and Ontario Street, by demanding money after threatening the victim with a pistol.
MODEST and CALDWELL, both of Albany, NY, pled guilty to Attempted Robbery earlier this year and will serve 10 and 12 years, respectively, in prison.
Chief Assistant District Attorney Dave Rossi and Assistant District Attorney Steven Sharp handled the prosecution of the case.
